Online Casinos Defended in iMEGA Suit Against UIGEA
Lawyers for the InteractiveMedia Gaming and Entertainment Association filed suit today in the Third District of U.S. Circuit Court, seeking to have the Unlawful Internet Gambling Enforcement Act voided for unacceptable vagueness in its terms. In the complaint, iMEGA asked that the Unlawful Internet Gambling Enforcement Act be voided for vagueness, tossing the law out.
Joe Brennan, Jr., CEO and chairman of iMEGA, said that, by not defining what an “unlawful Internet gambling transaction” is, Congress has placed an unfair burden on banks and financial institutions.
Brennan stated on iMEGA's home page, "The Department of Treasury, which has been tasked with drafting the regulations for UIGEA, has testified before Congress that they themselves cannot make that determination. Because Congress refused to draft necessary standards, the law is so inherently flawed as to make it totally vague and unenforceable, and we are confident that the Court will overturn it.”
Among the many positive affects of tossing out the UIGEA and clearing the path to legal and taxed online casinos would be the billions in revenue that could be collected by the U.S. Treasury.
